2009 OFFICIAL RULES
NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE U.S. AT THE TIME OF ENTRY.
1. ELIGIBILITY: Open only to legal residents of the forty-eight (48) contiguous United States and the District of Columbia 18 years of age and older. The following are not eligible: employees, contractors, directors and officers of John B. Sanfilippo & Son, Inc. (the "Sponsor"), its parent, subsidiaries and affiliated companies, distributors, web design, advertising, fulfillment, legal, judging and Contest agencies involved in the administration, development, fulfillment and execution of this Contest (collectively, "Contest Parties"), and the immediate family members of each such person (spouse, parent, child, sibling, grandparent, and spouse or "step" of each) and those living in the same households of each such person (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Contest).
2. CONTEST ENTRY PERIOD: You may enter the Contest between 12:00 AM Central Time ("CT") on 11/6/09 and 11:59:59 PM CT on 12/16/09 ("Contest Entry Period"). The Web Site clock is the official clock for this Contest.
3. TO ENTER: Create an original recipe using any Fisher Nuts products and up to four other ingredients, including step-by-step directions. To enter your recipe, log on to www.Fisherplus4.com ("Web Site") during the Contest Entry Period. After you have registered and signed in, click on the "Get Started" link and follow the on-screen directions to submit a recipe in one of the following recipe categories:
- Breakfast
- Lunch
- Appetizers
- Dessert
- Dinner
4. SELECTION OF FINALISTS: All eligible entries will be judged by a qualified panel of judges based on the judging criteria stated below. Recipes will not be prepared. The one (1) Entry in each recipe category with the highest scores for that recipe category will be deemed a finalist ("Finalists"), for a total of five (5) Finalists. An entrant may not be a finalist in more than one category.
5. JUDGING: Judging will be based on the following criteria:
(#1) Originality And Creativity (40%) - Uniqueness and creativity of recipe.
(#2) Likely Appetite Appeal if Prepared (40%) - Written description provides sense of a good tasting recipe.
(#3) Perceived Ease of Preparation (20%) - Your Entry must be easy for users to prepare and include ingredients that are available everyday.
In the event of a tie, the tie breaking Judge will re-judge the tied Entries to determine the Finalist(s) based on Originality and Creativity of Recipe, continuing thereafter to each Judging Criteria in order, as needed to break the tie. Sponsor reserves the right to advance fewer Finalists to the Selection of Winners phase if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries for a recipe category. Entrants agree that the Judges have the sole right to decide all matters and disputes arising from this Contest and that all decisions are final and binding.
6. FINALIST PRIZES: Each of the five (5) Finalists will each receive a $500 Gift card to cooking.com and Eight (8) $5 Fisher Nuts product coupons. Gift card is subject to the terms and conditions set by issuer and stated thereon. Cooking.com is not a Sponsor of or affiliated with this Contest in any way. Approximate Retail Value ("ARV"): $540.
7. SELECTION OF WINNERS: After the five (5) Finalists have been selected and verified, the Finalist Entries will be posted online at www.Fisherplus4.com on or about 1/7/10 and Web Site visitors (including Contestants) will be able to vote for their favorite Recipe (based on creativity and taste). To vote, visit www.Fisherplus4.com and follow the directions to vote. The voting period begins at 12:00 AM CT on 1/7/10 and ends at 11:59:59 PM CT on 1/26/10 (the "Voting Period"). Limit one (1) vote per person and per email address per day. A "Day" is defined as the 24 hours between 12:00:01 AM CT and 11:59:59 PM CT. Votes received from any person or email address in excess of stated limitation will be void. Automated methods of voting (including votes made by script, macro and bot) and votes by any means which subvert the voting process are strictly prohibited and all such votes will be void. Finalists are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by Sponsor in its sole discretion. Voting through multiple accounts is strictly prohibited. The Finalist that receives the highest number of valid votes, as determined by Sponsor, will be deemed the Grand Prize winner. In the unlikely event of a tie, the Judges will select the winner based on which Finalist received the highest score(s) in the Selection of Finalists phase and such Finalist will be deemed the winner. Entrants agree that the Sponsor and Judges have the sole right to decide all matters and disputes arising from this Contest and that all decisions of Sponsor are final and binding. Prize awards are subject to verification of eligibility and compliance with these Official Rules.
8. ONE (1) GRAND PRIZE: a check payable to winner in the amount of $1,000.
9. GENERAL CONDITIONS: The winners of the Grand Prize and Finalist Prizes are solely responsible for all federal, state and local taxes on the prize and any other costs and expenses associated with prize acceptance and use. The Grand Prize winner will be issued an IRS Form 1099 for the value of the prize. No cash equivalent or substitution of Finalist Prizes (or any portion thereof) is offered, except at the sole discretion of the Sponsor. Sponsor reserves the right to substitute Finalist Prize with one of comparable or greater value. Prizes are non-transferable and non-refundable. All prize details are at Sponsor's sole discretion. By participating, entrants agree to these Official Rules, the decisions of Sponsor and Judges, which are final and binding in all respects. The potential Grand Prize winner will be notified by phone and/or e-mail and will be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release within ten (10) days of date of attempted notification. In the event that winner does not comply with the provisions set forth in the preceding sentence, the Grand Prize may be forfeited and awarded to the runner-up. If for any reason the Contest is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible for the Contest Interruption or who tampers with the entry process, and to cancel, modify or terminate the Contest. This Contest is offered only in the United States and is governed by the laws of Illinois and all claims must be resolved in the state courts located in Kane County, or the federal courts in Illinois.
10. LIMITATIONS OF LIABILITY AND HOLD HARMLESS/RELEASE: No liability or responsibility is assumed by Contest Parties resulting from entrant's participation in or attempt to participate in the Contest or download any information in connection with participating in the Contest. Contest Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled Entries, or votes. No responsibility or liability is assumed by the Contest Parties for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Contest: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent to or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestions on the Internet or the Web Site; unauthorized human or non-human intervention of the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Contest, or loss, miscount, misdirection, inaccessibility or unavailability of an account used in connection with the Contest. Contest Parties are not responsible for any typographical, printing, network, mechanical, electronic, human or other errors in the connection with this Contest, including without limitation, the announcement of prizes, the tabulation of votes, the processing of Entries, errors in these Official Rules, any Contest-related materials, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user's own risk. Contest Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer equipment resulting from participation in the Contest, use of the Web Site or the download of any information from the Web Site. By participating in the Contest, the entrant (and, if eligible minor, his/her parent or legal guardian) agrees to indemnify and hold Contest Parties harmless from any and all claims that Entrant's recipe infringes the rights of any third party and to thereby release Contest Parties from any and all claims, loss, injury, damages or liabilities arising in whole or in part, directly or indirectly from participation in the Contest or acceptance, misuse or use of any prize. Except where prohibited by law, by accepting prize, each winner (and, if eligible minor, his/her parent or legal guardian) thereby grants permission for Sponsor and those acting under its authority to use his/her name, city and state of residence, photograph, voice and/or likeness, for advertising and/or publicity purposes, in any and all media now known or hereinafter invented without territorial or time limitations and without additional compensation, notification or permission. In the event of a dispute as to the identity of an online entrant, the authorized account holder of the email address used to enter will be deemed the entrant and he/she must comply with these Official Rules as a condition to receiving the Grand Prize or a Finalist Prize. Authorized account holder of the email address is defined as the person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning emails for the email address associated with the submitted entry.
11. WINNERS' LIST/RULES REQUEST: For a list of Winners, or a copy of Official Rules, send a self-addressed, stamped envelope specifying "Official Rules" or "Winners' List", received by 1/26/10 to: Fisher + Four Challenge "Official Rules" or "Winner List" Request, P.O. Box 1095, Elmhurst, IL 60126. VT residents may omit return postage on rules requests.
